WAIVER AND RELEASE OF LIABILITY OMAR FRENCH BRAZILIAN JIU JITSU (TULSA BJJ LLC) ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION AGREEMENT 1. ACTIVITIES AND INHERENT RISKS I understand that Brazilian Jiu Jitsu, Judo, Muay Thai, fitness conditioning, self-defense, grappling, striking, and other martial arts or physical activities offered by Tulsa BJJ LLC (the “Activities”) involve strenuous movement, close physical contact, falls, takedowns, throws, joint locks, chokes, and strikes. Inherent risks include, without limitation, bruises, sprains, fractures, concussions, joint dislocations, infection, serious bodily injury, permanent disability, paralysis, and death. These risks may arise from my actions, the actions of other participants, equipment, or facility conditions. 2. VOLUNTARY ASSUMPTION OF RISK I voluntarily choose to participate and knowingly assume the inherent and other risks of the Activities. I agree to follow academy rules and instructor directions, use appropriate care, and stop participating and notify an instructor if I feel unsafe, ill, or injured. 3. RELEASE AND WAIVER OF LIABILITY To the fullest extent permitted by Oklahoma law, I release and discharge Tulsa BJJ LLC, doing business as Omar French Brazilian Jiu Jitsu, and its owners, directors, officers, instructors, employees, volunteers, affiliates, agents, and facility providers (the “Released Parties”) from claims, demands, damages, costs, or causes of action arising from ordinary negligence connected with my participation in the Activities. This release does not apply where prohibited by law and does not release gross negligence or willful misconduct. 4. INDEMNIFICATION To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from third-party claims, liabilities, damages, or reasonable expenses arising from my conduct during the Activities, including injury or damage I cause to another person or property. 5. HEALTH AND MEDICAL ACKNOWLEDGMENT I represent that I am physically able to participate, will disclose relevant limitations to an instructor, and will seek medical advice when appropriate. If emergency care is reasonably necessary and I cannot provide consent, I authorize academy personnel to seek emergency medical assistance. I understand that I remain responsible for resulting medical and related costs. 6. COMMUNICABLE DISEASE AND SKIN INFECTION I understand that close-contact training can expose participants to communicable illness and skin infections, including ringworm, staph, and MRSA. I will follow hygiene rules, will not train with a suspected contagious condition, and will notify staff promptly. I voluntarily assume these inherent exposure risks, subject to applicable law. 7. PERSONAL PROPERTY I understand that Tulsa BJJ LLC is not responsible for lost, stolen, or damaged personal belongings except where liability cannot lawfully be waived. 8. MINORS If the participant is under 18, the signing parent or legal guardian confirms authority to sign, gives permission for the minor to participate, and makes the acknowledgments in this agreement on the minor’s behalf to the fullest extent permitted by law. 9. GOVERNING LAW; SEVERABILITY This agreement is governed by Oklahoma law. If any provision is held unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law. 10. ELECTRONIC RECORD AND SIGNATURE I consent to receive and sign this agreement electronically. I understand that I may request a printable copy. By typing my full legal name and submitting this form, I intend to sign this agreement electronically. The signed record will include the agreement version and date and time of signature. 11. ACKNOWLEDGMENT I confirm that the information I provided is accurate, that I had the opportunity to read this agreement, that I understand I am giving up substantial legal rights, and that I sign freely and voluntarily without coercion. I HAVE READ AND UNDERSTAND THIS AGREEMENT AND INTEND MY SIGNATURE TO BE A COMPLETE RELEASE TO THE FULLEST EXTENT PERMITTED BY LAW.
